Prenuptial agreements in Thailand

Let us consider and protect your position with a Thai Prenuptial agreement. Under Thailand family Law this agreement is a written contract between the parties to be married. It must be in both Thai and English signed and registered at the time date and place where the marriage takes place.

The Thai Prenuptial Agreement would normally document what each party owns whether in Thailand or overseas and would define the rights of the parties involved both during marriage and in the event of death or divorce which can be common.

The agreement would usually consist of property owned by each party before marriage. The rights and obligations of the parties and what their property rights are in the event of a divorce. How the property is managed and financed during the marriage.

Prenuptial agreements in Thailand are common place. They are used to define and protect parties’ assets, property and valuables etc. which one party may wish to keep as separate property. They are also used to establish and document debt which they may bring to the marriage.

Prenuptial agreements

Prenuptial agreements in Thailand sets out between parties’ financial agreements which can be openly discussed before marriage so that all parties are aware of assets and debts, what assets will be common and what assets will be personal in the future in the event of divorce. The agreements also pave the way in the event of divorce by preventing disputes over property as both parties agree on division prior to marriage and would know what to expect should divorce or dissolution occur later.

A Prenuptial Agreement in Thailand can be for a specified time after which it can become null and void or can contain a provision for withdrawal. The agreement however cannot be amended or altered without the permission of the court.
