The legal framework for Buying Property in Thailand is primarily governed by the Thai Civil and Commercial Code (CCC), which addresses contracts, sales, and liabilities, alongside the specific restrictions of the Land Code Act and the Condominium Act. Land and Houses (Restricted Ownership)
The Land Code Act strictly prohibits direct foreign national ownership of land in Thailand. The CCC, particularly Sections 456, 458-460, governs the sale and transfer of ownership. Since direct land ownership is restricted, foreigners must utilize alternative, legally compliant structures to secure long-term control over land and the house built upon it:
- Long-Term Leasehold: Governed by CCC Sections 537-571, this provides the right to use land for up to 30 years, with the possibility of renewal.
- Usufruct/Superficies: These real rights (governed by CCC Sections 1417-1428 and 1410-1416 respectively) are registered on the title and offer strong security and control over the use and benefit of the property, separate from the land ownership.
- House Ownership: Crucially, a foreigner can own the building (house) built on the land, separate from the land itself, provided the proper documentation is executed and recorded at the local administrative office.
Condominiums (Freehold Ownership)
Condominiums are the most straightforward path for Expats and Foreign Nationals. Under the Condominium Act, foreigners can own freehold title to a unit, provided that foreign ownership does not exceed 49% of the total saleable floor area of the building. To register this ownership, funds must be remitted from overseas in foreign currency, ensuring full compliance with the Act.
