Divorce in Thailand. There are a number of ways to divorce in Thailand. Thailand family law allows for consent between both parties or where consent is not provided then via court proceedings. Agreements and proceedings can deal with the ending of the marriage itself, division of assets, child contact and custody and financial support to name but a few.

Uncontested divorce
This is where parties terminate the marriage by consent. It speeds up the process where parties are amicable and can register the agreement as to children property and finances. Both parties must be in agreement to do this and would have to sign the divorce in Thailand agreement and have it registered at the Ampur to be official and binding.
There can be no disagreement between the parties in respect of property finances or children.
The agreement would contain all agreed aspects with regards to sharing of assets, division of property, alimony and or child support where required.
If agreement cannot be reached and if and only if you have a ground for divorce then application for a divorce via court proceedings can be initiated. The court would then consider if a divorce should be granted and would decide the terms of property division, division of assets, alimony, contact or custody etc.
This leads on to the second way to divorce in Thailand.
Divorce in Thailand via Court proceedings
Contested divorces occur when either one of the parties involved does not agree to terms within the consent process or has broken the marriage agreement itself.
To Divorce via court proceedings you must have a ground under Divorce In Thailand Law, these are,
- Desertion for one year and over ( bear in mind that if you have children and or you make contact with them or your spouse in that year the court will not grant a divorce and the time period starts again from last contact)
- A 3 year period of separation
- Found guilty of misconduct and or sentenced to a specified period
- Adultery
- The male party has taken another female party as his wife
- One party has physically or mentally abused the other
- Insanity which is incurable for a period of 3 years plus
- Maintenance and support has not been provided
- The bond of good behavior has been broken
- Disease which is dangerous, communicable and incurable
